MGZ is suing its own fund for UAH 10.2 million over an unfinished sports facility in the Korablevskyi district

The company seeks to terminate the donation agreement with the Charitable Foundation "Center for Social Programs" and to return the funds earmarked for the facility in the Korabelnyi District

Mykolaiv Alumina Plant applied to the court seeking to terminate the donation agreement with the charitable foundation “Center for Social Programs” and to recover 10.2 million hryvnias that were allocated for the construction of a sports ground in the Korabelnyi district of Mykolaiv; the preparatory hearing in the case took place on 20 January, and further consideration is scheduled for April 2026.

According to the court register, the corresponding proceeding is before the Commercial Court. The plaintiff demands the return of funds due to the charity’s failure to fulfill the terms of the agreement.

The parties signed the donation agreement on 20 October 2021. The company transferred to the foundation 10.3 million hryvnias for the implementation of the project “New construction of a sports ground on the territory of the sports town ‘Korabelnyi’ near the sports complex ‘Vodoliy’ in Mykolaiv.” The facility was planned to be transferred to the city’s communal ownership by 1 June 2022, however only about 60 thousand hryvnias of the total amount were actually used.

In the foundation’s report for 2021, the notes state that the implementation of this project was stopped. The Korabelnyi district administration and the city Department of Physical Culture and Sports also joined the cooperation under the agreement.

Background on the charity: “Center for Social Programs” was registered on 10 November 2004, with Olena Ozhema listed as director; the main activity is the provision of other social assistance without accommodation. According to data from the Opendatabot service and the analytical system YouControl, Mykolaiv Alumina Plant was a founder of the foundation and was under the subordination of the RUSAL group of companies, and the foundation is now under the management of the State Property Fund of Ukraine.

The case materials refer to prolonged non-fulfillment of agreements and misuse of the allocated funds. They record the following wording:

— For almost four years MMBF “CSP” did not commence construction of the sports ground, and with the start of the war it did not undertake any actions aimed at implementing the project. Therefore, the defendant, in violation of clauses 2.1, 2.2, 3.4, 3.5 of the agreement, did not comply with the agreement’s conditions regarding the use of the donation in the amount of UAH 10,249,976.60 for the purposes provided for and agreed by the parties to the agreement, — the case materials say.

During the preparatory hearing on 20 January, the court established that the text of the agreement attached to the case was presented in Russian, therefore MGZ was required to submit a notarized translation into Ukrainian. The next hearing is scheduled for April 2026.
