Shot a four-month-old German Shepherd: in the Mykolaiv region a man was sentenced to 5 years

The punishment was replaced by a one-year probationary period

Bashtanskyi District Court of Mykolaiv Oblast found a man guilty of killing a dog. He was sentenced to 5 years imprisonment, but was released from serving the sentence with probation for 1 year.

The incident occurred on 31 May. The man shot a four-month-old shepherd dog named Aya with a hunting shotgun. He believed that the day before the dog had killed his poultry. The animal was chained in the yard.

The dog’s owner heard a noise in the farmyard and found the dead Aya. She then called the police. During the court hearing the woman stated that her dog could not have left the yard because it was either in an enclosure or on a leash. According to her, the poultry could have been killed by a dog from another household whose owner had left and abandoned the animal.

“The victim insisted that the chickens were killed by a dog from another household, whose owner had left and abandoned the dog. Her dog named ‘Aya’ could not have left the property because it was either in an enclosure or on a leash. She asked that the accused not be punished harshly; she has no claims against him.”

In court the man admitted his guilt and said he acted in a state of emotional agitation. The owner of the deceased animal had no claims against him and also asked that a harsh punishment not be imposed.

The court found the man guilty under part 3 of Article 299 of the Criminal Code of Ukraine — for cruel treatment of an animal. He was sentenced to 5 years imprisonment, but pursuant to Article 75 of the Criminal Code of Ukraine was released from actually serving the sentence with a probationary period of 1 year.
