A tree fell on a Mercedes: a Mykolaiv resident demands more than 198 thousand from "Mykolaiv Parks"
The court requested documents regarding tree maintenance on Mariupolska Street
May 21 a tree fell on a parked Mercedes-Benz near house No.59 on Mariupolska Street in Mykolaiv and damaged the car. The car owner went to court and is seeking more than UAH 198,000 in compensation from KP “Mykolaiv Parks” — that is the amount an expert preliminarily estimated for the repairs. According to reyestr.court.gov.ua.
The plaintiff believes that the municipal enterprise failed to properly carry out its tree maintenance duties, which led to the incident that damaged the vehicle.
On July 7 the Zavodskyi District Court of Mykolaiv opened proceedings and scheduled the case for consideration. At the preparatory hearing on September 22 the car owner’s representative asked that the enterprise be required to provide documents concerning the area where the tree fell. The court granted this motion.
KP “Mykolaiv Parks” must provide information on whether the area near house No.59 on Mariupolska Street is on the enterprise’s balance sheet or under its maintenance, as well as its charter.
In addition, the court requested inspection reports of the green plantings at that address, logs of planned and unplanned tree inspections, and documents on sanitary pruning and removal of hazardous trees. The next hearing is scheduled for October 16.
During storms, trees in Mykolaiv fall fairly often. After such incidents residents say they repeatedly asked KP “Mykolaiv Parks” to remove dangerous trees, but, they claim, the municipal services only partially trimmed branches without fully addressing the problem.
After one such incident the head of the Department for Emergency Situations and Civil Protection of the Population of the Mykolaiv City Council, Roman Voznyak, explained that rescuers cannot remove trees that fell on cars during bad weather if the car owner is not present.
