The pavilion in the "Mayak" zone of Mykolaiv will be dismantled

In Mykolaiv, the territory of the recreational area “Mayak” on the shore of the Buzkyi Lyman in the “Zhovtneve” tract is being tidied up. The executive committee of the city council on September 9 approved the dismantling of a trading pavilion located on a city land plot closer to the water. The temporary structure must be removed by March 31, 2027.

During the inspection, specialists found several temporary structures and amenity objects that are being used for commercial activities. They are located in two designated zones — on opposite sides of the dirt road.

The decision regarding the pavilion on city land states that the structure was erected in violation of urban planning and land legislation. The Department of Architecture and Urban Planning of the Mykolaiv City Council reviewed the situation and appealed to the prosecutor’s office for response within its competence.

Other objects located closer to the forest are being checked separately. The city’s chief architect, Yevhen Polyakov, explained that this territory belongs to forestry lands and is under the corresponding use regime.

It was on this plot that trees were cut down en masse last year, after which the following appeared there:

• a trading pavilion;
• a toilet;
• gazebos;
• barbecue grills;
• other amenity structures.

Forestry lands have a special legal regime. The legislation allows their use, in particular, for recreational and tourist purposes, but the mere presence of a pavilion, a toilet, tables, or other objects does not confirm the legality of their placement.

According to a statement by the Department of Architecture and Urban Planning, a verification of the legal grounds for using this territory is underway. It should establish the legality of the placement of the structures and clarify the circumstances of the tree felling.

Thus, the city authorities differentiate between two situations: the pavilion on city land has already been slated for dismantling, while there is no final conclusion yet regarding the structures on forestry lands — their legal status continues to be examined.
