In Mykolaiv, a court accepted a bankruptcy petition for SC "Metallurg" — a division of MGZ

The Commercial Court of Mykolaiv Oblast accepted for consideration an application from LLC “Miroil” to open insolvency proceedings in the case of LLC “Service Center “Metallurg”. The corresponding ruling of 24 August 2026 in case No.915/1213/26 was issued by Judge Davchenko T.M.

The debtor is registered at: Naberezhna Street, 64, village Halytsynove, Mykolaiv Raion, Mykolaiv Oblast. Korabelov.info previously reported that “Service Center “Metallurg” is a unit of the nationalized Mykolaiv Alumina Plant. In particular, in 2024 the court ordered the enterprise to pay the Pension Fund over 1.9 million hryvnias.

Importantly, the enterprise has not yet been declared bankrupt, and bankruptcy proceedings have not been opened. The court only accepted the creditor’s application for consideration. The validity of the claimed claims and the existence of grounds for opening proceedings will be checked during the preparatory hearing.

LLC “Miroil” filed the application on 11 August 2026, and it was received by the court on 12 August. The creditor asks to recognize monetary claims against “SC “Metallurg” in the total amount of UAH 825,811.56, of which:

• UAH 126,847 — claims of the first priority;
• UAH 698,964.56 — claims of the fourth priority.

The creditor also proposed to appoint the insolvency administrator Potupalo Nataliya Ihorivna as the property manager, who gave her consent to participate in the case.

Separately, LLC “Miroil” requested to obtain the VAT tax reports of “SC “Metallurg” for 2021–2022. This concerns declarations and annexes that reflect the creditor’s tax invoices.

LLC “Miroil” explained the need to obtain the documents by stating that its primary accounting records remained in a rented office in temporarily occupied Berdyansk, Zaporizhzhia Oblast. The creditor contacted the debtor with a claim and a request to provide the relevant reports, but received no response. The Main Department of the State Tax Service in Mykolaiv Oblast also refused to provide the company with this information.

The court granted the creditor’s motion and obliged “SC “Metallurg” to provide its incorporation documents, a response to the application, and VAT tax reports for 2021–2022 no later than three days before the hearing. The Tax Service was ordered to transfer the necessary documents by 3 September 2026.

The preparatory hearing is scheduled for 7 September 2026 at 15:30. It is to take place at the Commercial Court of Mykolaiv Oblast at: city of Mykolaiv, O. Vadaturskyi Street, 14. The creditor’s representative Zabarin Anton Fedorovych will participate in the hearing remotely.

Pending consideration of the question of opening proceedings, the court prohibited the owner of the property and LLC “Service Center “Metallurg” itself from making decisions on liquidation or reorganization of the enterprise, as well as from disposing of its fixed assets.

This is not the first court case related to the enterprise’s financial obligations. In November 2024 the Commercial Court ordered “SC “Metallurg” to pay a supplier almost UAH 185,000. At that time the company explained the inability to pay due to blocked banking operations and asked to defer enforcement of the decision, but the court refused.

The ruling dated 24 August 2026 came into legal force from the moment of its adoption and is not subject to appeal.
