Lubinets, after an appeal from Dnipro about an injured person: balaclavas on TCC staff are unacceptable

The ombudsperson raised the question of the legality of such actions and reminded: representatives of the TCK must be identifiable and present their identification

Verkhovna Rada Commissioner for Human Rights Dmytro Lubinets stated that the use of balaclavas by employees of the TCC and SP during mobilization actions is unacceptable, responding to an appeal from a resident of Dnipro about her husband being injured by people in military uniforms and masks.

“I constantly emphasize that the use of balaclavas during mobilization measures is unacceptable. People have the right to understand who is approaching them, who stops them, detains them, or uses force. When individuals are concealed — it is impossible to identify those who may potentially violate human rights or commit criminal offenses,” said Dmytro Lubinets.

According to the ombudsman, a woman from Dnipro contacted him, reporting that her husband sustained injuries after actions by a group of people in balaclavas and military uniforms, whom she believes to be representatives of the TCC and SP. Lubinets added that the injuries are serious and released a video featuring the victim and his wife.

“I must raise an important question. Is it lawful for notification measures of those liable for military service to be carried out by persons in masks (balaclavas) that make it impossible to identify representatives of a state body? According to Ukrainian legislation, representatives of the TCC and SP while performing their official duties must be properly identified and present service IDs. Concealing the face causes people to distrust and not understand who exactly is in front of them, which directly affects the assessment of such events,” the ombudsman’s statement reads.
