A full-time student was mobilized in Zakarpattia — the court did not overturn his conscription
The TCC questioned whether the man was actually pursuing an education
A full-time student in Zakarpattia failed to have the decision to conscript him overturned: the Zakarpattia District Administrative Court dismissed his claim. Challenging his mobilisation, the man cited his right to a deferment.
The circumstances set out in the case file concern his interaction with representatives of the Territorial Recruitment and Social Support Centre (TCC). Centre staff became unsure whether he was actually studying. The man was asked about his degree programme and the subjects he was taking, but he struggled to answer. He was mobilised after this conversation.
In addition to seeking to overturn the conscription decision, the man asked the court to declare the TCC’s actions unlawful.
After reviewing the case, the court concluded that the Centre had grounds to make the decision at the time of his mobilisation.
