Repeatedly caught drunk, had his license revoked, but got behind the wheel again: the person responsible for the fatal crash faces trial
How many more violations were needed?
The driver Toyota RAV 4, who 23 September caused a fatal road traffic accident on Troitska Street in Mykolaiv, turned out to be far from a newcomer among traffic offenders. The man had repeatedly been prosecuted for driving under the influence, and at the time of the crash he had been deprived of the right to get behind the wheel. After the accident the driver also left the hospital and disappeared, but the next day police found him.
As we already reported, 23 September at about 21:25 the driver of the crossover Toyota RAV 4 on Troitska Street in Mykolaiv drove off the carriageway and crashed into a house fence.
As a result of the accident the driver and two passengers — a 28-year-old woman and a 46-year-old man — were taken to hospital with injuries of varying severity. Later the 46-year-old passenger died. The woman continues to receive treatment.
According to preliminary police information, the driver may have been intoxicated. After being hospitalized he left the medical facility without authorization and disappeared in an unknown direction.
The next day law enforcement officers established the man’s whereabouts. Investigators detained him in accordance with Article 208 of the Criminal Procedure Code of Ukraine.
During the investigation it emerged that this was far from the first time the man had problems with the law over driving a car. He had repeatedly been held administratively liable for driving vehicles while intoxicated under parts 1 and 2 of Article 130 of the Code of Ukraine on Administrative Offences (КУпАП).
Moreover, at the time of the fatal accident the man had no right to drive a car at all: he had previously been deprived of that right under part 5 of Article 126 of the Code of Ukraine on Administrative Offences (КУпАП).
Law enforcement ordered examinations that should finally determine whether the driver was in a state of alcohol, drug, or other intoxication during the accident.
On 25 September investigators of the transport unit of the investigative department of the Mykolaiv Region police, under the procedural supervision of the prosecutor’s office, informed the man of suspicion under part 2 of Article 286 of the Criminal Code of Ukraine — violation of traffic safety rules or vehicle operation that caused the death of the victim.
At the same time, the police’s official statement contains a discrepancy regarding the age of the person involved: in the notice of suspicion he was called 38 years old, whereas in the description of the accident itself it is indicated that the driver is 39 years old.
Now the suspect awaits court, which is to soon decide on a preventive measure for him.
The penalty under part 2 of Article 286 of the Criminal Code of Ukraine provides for up to 8 years imprisonment with deprivation of the right to drive vehicles for up to 3 years.
