Forced a female motorcyclist to dismount and smashed her Kawasaki: serviceman sentenced in Mykolaiv

Zavodskyi District Court of Mykolaiv sentenced a service member to 1 year of probationary supervision for attacking a motorcyclist and damaging her vehicle. The man was intoxicated when he forced the rider to leave the motorcycle and then began to strike it with a stone.

The incident occurred on August 18 at about 21:40 near house No. 7 on Central Avenue in Mykolaiv. Seeing a Kawasaki Ninja 300, the man stopped it for no reason and ordered the rider to get off the vehicle.

After that the service member took a stone and inflicted at least 10 blows on the motorcycle. The front headlight was smashed, the handlebars, the front plastic parts and other body panels were damaged. After the attack the vehicle became unfit for further operation.

The owner’s material damages were estimated at 228,695 hryvnias. The motorcyclist also stated that the attacker threatened her with a pistol, but no weapon was found on him after his detention.

The court found the man guilty of hooliganism — a gross violation of public order due to obvious disrespect for society, accompanied by particular insolence. The verdict was published in the Unified State Register of Court Decisions.

The convicted man serves as a motorman-electrician on a patrol boat and holds the rank of senior seaman. He had no prior convictions, has a positive service record at his place of duty and supports 2 minor daughters.

Mitigating circumstances were the man’s sincere remorse and compensation for the damages. At the same time, the court took into account as an aggravating circumstance that the offense was committed while intoxicated.

During the 1 year of probationary supervision the service member must regularly report to the probation authority, notify about any change of residence or workplace and not leave Ukraine without approval. He was also ordered to pay 7,701.76 hryvnias spent on the examination.

The verdict may be appealed within 30 days.
