Disability with a prosecutor's pension: 72% of reviewed diagnoses were not confirmed

In Ukraine, for 316 out of 437 prosecution employees who underwent the review, the previously established disability was not fully confirmed. This amounts to 72.3% of the total number checked. This is stated in the response of the Office of the Prosecutor General to a request from OBOZ.UA.

Based on the results of the review:

Disability was completely revoked for 207 prosecution employees;
For 109 people the group or the period for which it was assigned was changed;
for 121 employees, or 27.7%, the disability was confirmed without changes.

In November 2024, 523 people with disabilities worked in the prosecutor’s offices. As of August 2026, their number had decreased to 337. At the same time, the Office of the Prosecutor General does not separately record how many employees with disabilities resigned. Therefore, the reasons for the reduction in their number in each specific case are unknown.

According to the publication, some prosecutors are contesting the results of repeated medical examinations and are trying to regain the status of a person with a disability through the courts. Prosecutors’ interest in such a status may be explained by special conditions for pension entitlement. According to Art. 86 of the Law of Ukraine “On the Prosecutor’s Office”, prosecutors with disabilities of group I or II may receive the corresponding pension if they have at least 10 years of service in the prosecutor’s offices, regardless of age.

For a regular prosecutor’s length-of-service pension, it is necessary to have at least 25 years of total service, of which at least 15 years must be in prosecutorial positions.

Having a disability does not prohibit a prosecutor from continuing to work. Therefore, a prosecutor can simultaneously receive a salary and a special pension.
