Clash at a gas station in Mykolaiv region: outsiders beat and robbed locals

A clash occurred at a gas station in February 2023; two individuals involved will be held in custody until the verdict becomes legally binding

In the Voznesensk district of Mykolaiv region, the court handed down a guilty verdict to three residents of the Kirovohrad region who carried out an attack at a gas station in the village of Vozsiatske in February 2023. According to the regional prosecutor’s office, the perpetrators provoked a conflict with local residents that escalated into violence, robbery and illegal deprivation of liberty. Several crimes are involved at once: intentional minor bodily injury (Part 2 of Art. 125 of the Criminal Code of Ukraine), theft of official documents (Part 1 of Art. 357), unlawful deprivation of liberty committed by a group of persons (Part 2 of Art. 146), as well as robbery under martial law (Part 4 of Art. 186 of the Criminal Code of Ukraine).

The court established that during the conflict the attackers inflicted minor bodily injuries on one of the victims, after which they took his mobile phone and the vehicle documents. They forcibly restrained another man, effectively depriving him of his liberty, and also took his mobile phone. Although the defendants did not admit their guilt, the court agreed with the prosecution’s arguments.

The court imposed sentences of 8 years imprisonment, 7 years 6 months imprisonment and 3 years imprisonment with a 2-year probation period”

Taking into account the legal qualification of the defendants’ actions, the court sentenced one of them to 8 years imprisonment, the second to 7 years 6 months, and the third to 3 years imprisonment with a 2-year probation period. Two of the defendants will remain in custody until the verdict takes legal effect.

The pre-trial investigation was carried out by investigators of the Investigation Department of Police Station No. 1 of the Voznesensk District Police Department of the Main Directorate of the National Police in Mykolaiv region.

At the same time, the prosecutor’s office reminded that under Art. 532 of the Criminal Procedure Code of Ukraine, a first-instance court verdict takes legal effect after the deadline for filing an appeal has expired, if no appeal is filed. If an appeal is lodged — after the appellate court has made a decision.
