Domestic violence over 340 UAH: why the mother's beating led to a criminal conviction
The mother showed the police her bruises: in the Korablevnyi district a woman beat and abused her mother, and then ignored a program for offenders
Korabelnyi District Court of the city of Mykolaiv issued a criminal verdict against Yuliia T., who had earlier been found guilty of domestic violence against her own mother, but after that did not appear even once for the court-ordered program for perpetrators.
This concerns criminal case No. 488/1445/26, proceeding No. 1-кп/488/221/26. The verdict was delivered on 31 March 2026 in Mykolaiv. The court found the Mykolaiv resident guilty under Art. 390-1 of the Criminal Code of Ukraine — intentional evasion of participation in a program for perpetrators by a person to whom such measures were applied by a court.
The background of this case began in the summer of 2025. According to the ruling in case No. 488/3107/25, proceeding No. 3/488/823/25, on 18 July 2025 at around 13:00 the woman, while at her place of residence in Mykolaiv, committed domestic violence against her mother.
The court materials state that the actions were of a physical and psychological nature: there were slaps, shoves and insults directed at the victim using obscene language. The court concluded that physical pain and psychological suffering were inflicted on the mother, as well as harm to her physical and mental health.
Particularly telling in this case were the pieces of evidence examined by the court. In addition to the protocol on the administrative offense VAB No. 201686 dated 18 July 2025, the court took into account the written explanations of the victim and a video recording attached to the case files.
In the video, as stated in the ruling, the mother showed police officers bruises on her arms and explained that they resulted from physical violence by her daughter.
Another important detail is the neighbor’s statement. According to the case materials, he said that when the victim lived alone in the apartment, there were no disturbances. But after the daughter’s return, cries and the elderly woman’s pleas for help were constantly heard from their apartment.
The alleged offender herself did not appear at the hearing in the initial administrative case, although, according to the court, she had been duly notified by an SMS message delivered on 31 July 2025. The victim also did not come to court. Nevertheless, Judge Torzhynska T.V. reviewed the case based on the available written evidence, statements and the video recording.
On 11 August 2025 the Korabelnyi District Court of the city of Mykolaiv found the woman guilty under part 1 of Art. 173-2 of the Code of Ukraine on Administrative Offenses — committing domestic violence. She was fined UAH 340, and a court fee of UAH 605.60 was also imposed.
However, the matter did not end there. The court also referred the woman to the Department of Labor and Social Protection of the Population of the executive committee of the Mykolaiv City Council for participation in a correctional program for persons who committed domestic violence. The duration of the program was set at 3 months.
On 04 November 2025 an officer of Police Unit No. 3 of the Mykolaiv District Department, which services the Korabelnyi district of the city of Mykolaiv, acquainted the woman with the court ruling and handed her a referral to participate in the perpetrators’ program at the Mykolaiv City Center of Social Services at the address: Mykolaiv, St. Mark Kropyvnytskyi, 95-A.
She was also informed that evasion from participation in such a program carries criminal liability under Art. 390-1 of the Criminal Code of Ukraine. That is, as follows from the verdict, the woman knew about her obligation and about the possible consequences of failing to fulfill it.
However, according to a letter from the Department of Labor and Social Protection of the Population of the Mykolaiv City Council, as of 09 March 2026 she had not appeared even once to participate in the perpetrators’ program.
The investigation established that the woman, being fully aware of the duty imposed on her, had a real opportunity to attend the program, but without valid reasons did not come to the social services center. This became the basis for a new — criminal — case.
Criminal proceeding No. 12026153050000017 was entered into the Unified Register of Pre-Trial Investigations (ЄРДР) on 11 March 2026. The indictment was considered in a simplified procedure without a court hearing and without the presence of the participants, since the accused pleaded guilty, did not dispute the circumstances established by the investigation and agreed to such a procedure.
The woman’s statement of guilt was agreed by her defense counsel. The prosecutor also requested that the case be considered in the simplified procedure.
When determining the punishment, the court took into account that the accused had no prior convictions, has a secondary education, is officially unemployed, unmarried, is of middling reputation at her place of residence, and is not registered with a psychiatrist or narcologist. The court recognized sincere remorse as a mitigating circumstance. No aggravating circumstances were established.
As a result, the Korabelnyi District Court of the city of Mykolaiv found the woman guilty under Art. 390-1 of the Criminal Code of Ukraine and sentenced her to 1 year of probation supervision.
The convicted person was assigned 3 obligations: to periodically appear for registration with the probation authority, to notify about any change of residence, work or study, and not to leave Ukraine without the consent of the authorized probation body.
No preventive measure was applied. The verdict may be appealed to the Mykolaiv Court of Appeal through the Korabelnyi District Court of the city of Mykolaiv within 30 days from the date of receipt of a copy of the verdict.
