The administrator of a channel about draft notices in Mykolaiv was given a five-year suspended sentence
The man was given a two-year probation period, and his confiscated phones will be returned
The administrator of the “Mykolaiv Without TCC” Telegram channel, which published locations where mobilization measures were being carried out in Mykolaiv, received a suspended sentence. The Inhulskyi (Leninskyi) District Court of Mykolaiv sentenced the man to five years in prison but released him from serving the sentence, imposing a two-year probation period instead.
During this period, the convicted man must report regularly to the probation authority and notify it of any change of residence or employment. If he meets these obligations and commits no new criminal offense, he will not have to serve his prison sentence.
The channel had 384 subscribers. Its description promised information about TCC checkpoints and locations where draft notices were being handed out. The man moderated participants’ messages: he removed posts that were off-topic and blocked users who violated the rules. He also posted information himself about the locations and times of mobilization measures.
The court found that between August and October 2024, the administrator posted at least six such messages. They included photographs of military personnel and warnings about locations where representatives of the territorial recruitment centers were handing out draft notices.
The case describes, among others, the following posts:
- October 16, 2024 — a message about mobilization measures near the Black Sea Shipbuilding Yard. The author wrote that large numbers of TCC representatives and police officers were checking people entering and leaving the bridge, and advised drivers to take other routes.
- The following day — a post about TCC representatives operating near the Zorya-Mashproekt enterprise. It said that people were being stopped there frequently and issued draft notices.
The court concluded that such messages could help military-age men avoid encounters with TCC representatives and obstruct mobilization measures. The man was found guilty of obstructing the lawful activities of the Armed Forces of Ukraine and other military formations during a special period, under Part 1 of Article 114-1 of the Criminal Code of Ukraine.
On November 29, 2024, in the presence of his defense attorney, the man entered into a plea agreement with the prosecutor. He admitted his guilt and expressed remorse.
The court also ordered that the confiscated Samsung Galaxy A52 and iPhone 14 Pro Max mobile phones be returned to the convicted man.
