Family brawl in Korabelnyi: father and two sons beat three policemen and didn’t go to jail

Korablelny District Court of the city of Mykolaiv issued a verdict in the case on an attack on police officers in the Kulbakino neighborhood. According to court materials, the incident occurred on 05.04.2025 at approximately 17:15 near building No. 39 on Znam’yanska Street in Mykolaiv.

In the court file of the case No. 488/2100/25, the defendants are listed as Shmakov Oleksandr Vyacheslavovych, Shmakov Dmytro Vyacheslavovych and Shmakov Vyacheslav Mykhailovych.

According to open declaration data and public records, the victims in the case are employees of Police Department No. 3 of the Mykolaiv District Police: Lisnichuk Yevhen Ihorovych — senior district police officer, Bondar Yevhen Vyacheslavovych — deputy head of the division for preventive activities, Levchenko Vadym Mykolayovych — head of the prevention sector of PD No. 3 of the District Police.

The criminal proceedings were considered on charges under part 1 of Article 28, part 2 of Article 345 of the Criminal Code of Ukraine — intentional infliction of bodily injuries on an employee of a law enforcement agency in connection with the performance of his official duties, committed by a group of persons without prior conspiracy.

According to the verdict, that day the senior district police officer of Police Department No. 3 of the Mykolaiv District Police, the deputy head of that department for preventive activities and the head of the prevention sector were in Kulbakino while performing their official duties.

The police noticed two men who appeared to be intoxicated and decided to check their documents. When the officers began to move toward them, the men, upon seeing the police, started to flee.

One of them was stopped by the officers. At that moment, as stated in the verdict, the police saw a knife in his hand. They then attempted to detain the man and stop his unlawful actions. The court materials indicate that he threatened the police with the knife and shouted insults at them.

At that moment his father and brother joined the conflict. According to the prosecution’s version, they acted with the aim of preventing the detention and prosecution of the man. As a result, the three defendants began to inflict bodily injuries on the police officers.

One of the police officers was initially struck 3 times with a fist to the area of the left eye and the left side of the face. After that, when the officer was on the ground, the three men, according to the verdict, inflicted chaotic blows with hands and feet to his face and torso.

As a result of the attack, the police officer sustained a concussion, a closed displaced fracture of the nasal bones, bruises, contusions, abrasions, and an injury to the left eye. Forensic medical examination classified these injuries as minor but causing a short-term health disorder.

The second police officer, according to the case materials, was hit in the face by one of the defendants with a fist; another defendant delivered 3 kicks to the knee joint area of the left leg and 2 punches to the face. He was recorded as having bruises and contusions on the face, hand, thigh and knee.

The third officer was injured with a knife: the verdict mentions cutting wounds to 4-5 fingers of the right hand. In addition, he received at least 1 punch to the right shoulder.

After the case was considered, all three defendants concluded plea agreements with the prosecutor of the Mykolaiv City District Prosecutor’s Office. The agreements were signed on 08.04.2026.

The court took into account that the defendants had no previous convictions, admitted their guilt, participated in investigative actions, expressed remorse and informed the court of the circumstances of the incident. The verdict materials also state that compensation to one of the victims was paid voluntarily.

For one of the defendants, the court considered as an aggravating circumstance that the crime was committed while intoxicated. For another, the court considered that he has 3 minor children dependent on him. One more defendant is a pensioner.

As a result, the court sentenced two of the defendants to 3 years of imprisonment each, but released them from serving the sentence with a probationary period of 1 year. The third was sentenced to 1 year of imprisonment, also with a probationary period of 1 year.

In addition, the court cancelled the previously chosen preventive measure in the form of house arrest.

The physical evidence — a metal folding knife with the marking on the blade “Columbia USA” — the court ordered to be destroyed. Swabs taken from the hands of one of the defendants are also to be destroyed. The damaged dashcam model NC-M6B with serial number NC211596 the court ordered to be returned to its owner.

The civil claim of one of the victims against the defendants for compensation of material damage was left without consideration by the court, since, as stated in the verdict, the damage was compensated in full.

The verdict in case No. 488/2100/25 was issued on 08.04.2026. It came into legal force on 09.05.2026. In the court file the stage of consideration is already indicated as “Execution of the decision” from 11.05.2026.
