"Caught" the second time: a brawler from Korabelnyi who stabbed an acquaintance three times in the chest with a knife was sentenced to 5 years

April 15, 2026, for the severe wounding of an acquaintance, sentenced to up to 5 years in prison by the Korabelny District Court of Mykolaiv was local resident Oleksiy Pogorelov – a 29-year-old unmarried unemployed man with a specialized secondary education.

The incident occurred on May 9, 2023 (around 23:20) on the stair landing of the first floor of the fourth entrance of an apartment building on Okeanivska St.. While drinking alcoholic beverages, a conflict arose between the defendant and his acquaintance Maxym Y., during which Oleksiy inflicted on the man three stab wounds to the chest, thereby causing the victim bodily injuries in the form of a penetrating wound with damage to the lung and heart and a hemopneumothorax, which are classified as serious bodily injuries by the criterion of danger to life.

“The defendant fully admitted his guilt, expressed remorse, and in the court session did not dispute the circumstances of his intentional infliction of serious bodily injuries during an argument provoked by the victim, which escalated into a fight with the victim”, – said in the verdict of the court.

The victim told the court that they had been drinking vodka at the defendant’s home. Later the defendant began to behave inappropriately and aggressively toward him. At about 23:20 he went out onto the first-floor landing of the entrance. When the defendant caught up with him and turned him toward himself by the shoulder, Maxim felt a sharp pain near his right rib, after which he lost consciousness.

It should be noted that Oleksiy Pohorelov had previously – in 2023 – already been convicted of intentional minor bodily injury. He was sentenced then to 200 hours of community service, of which he served only 28 hours.

Therefore this time Judge Tetiana Holovina decided that the defendant’s correction was possible only by imposing a custodial sentence and only in places of deprivation of liberty isolated from society.

Note that a civil claim was filed by the victim in court, in which he asks to recover from the defendant as compensation for material damage the lost earnings due to being in the hospital and on subsequent sick leave (lost wages for 120 days), as well as to recover moral damages — 300,000 UAH, which the victim justified by the moral suffering caused by the crime committed against him, as well as by negative changes in his life, physical pain resulting from injury to his health, prolonged treatment, surgical intervention, inconveniences caused by the injuries, emotional strain, emotional and psychological distress, and changes to his ordinary household routine and way of life.

“The court, guided by the principles of reasonableness, balance and fairness, concludes that the victim’s claims are partially justified with respect to compensation for moral damages and determines its amount at 100,000 UAH, which are to be recovered in favor of the victim from the defendant.

The civil claim of the prosecutor in the interest of the state against Oleksiy Pohorelov for compensation of material damage is to be satisfied in full. From the defendant in favor of the state, represented by «City Hospital No. 5», the funds spent by the healthcare institution on treating the victim in the amount of 32,222 UAH are to be recovered,” – the judge decided.

The verdict may be appealed to the Mykolaiv Court of Appeal within 30 days from the date of its pronouncement.

The preventive measure with respect to Oleksiy Pohorelov, until the verdict takes legal effect, remained detention in custody.
