Child pornography on media and without actual imprisonment: what the Ship Court decided

The Korabelnyi District Court of Mykolaiv has handed down a verdict against a local resident who purchased and stored files of child pornography. The man fully admitted his guilt and cooperated with the investigation.

This is evidenced by the corresponding verdict of the court, published in the Unified State Register of Court Decisions.

Case details

As the court determined, from November 2024 to September 2025 the accused, while in his apartment, downloaded prohibited files from the Internet. To download pornographic content depicting minors he used the qBitTorrent program and a flash drive.

Law enforcement officers detected and documented instances of downloading photo and video files. During a search conducted at the end of February 2026, the seized computer equipment and storage media were sent for examination, which confirmed that the materials constituted child pornography.

Defendant’s reaction and the court’s decision

At the court hearing the defendant fully admitted his guilt under Part 1 of Article 301-1 of the Criminal Code of Ukraine (accessing, acquiring and storing child pornography without intent to distribute) and sincerely repented. Since the man had no previous convictions, has a minor daughter to support and assisted in solving the crime, the court considered the case under the simplified procedure (part 3 of Article 349 of the Criminal Procedure Code of Ukraine).

The court ruled:

To sentence the man to 1 year of probation supervision.
To deprive him of the right to hold positions or engage in activities related to working with children and organizing their education/leisure for a period of 1 year.
To apply special confiscation — the seized flash drives, memory cards and hard drives were transferred to the state.
To recover from the convicted person in favor of the state over UAH 21.8 thousand for conducting forensic examinations.

The verdict may be appealed to the Mykolaiv Court of Appeal within 30 days from the date it was announced.

What does probation supervision entail?

During the year the sentenced person is obliged to periodically appear for registration with the probation authority, notify about changes of residence or work, and is prohibited from leaving Ukraine without approval. In case of evasion from serving the punishment he faces a real term — restriction of liberty for up to three years.
