The land had previously been transferred to a private individual for the construction of a residential building. The <strong>Central District Court of Mykolaiv<\/strong> upheld another claim by the <strong>Mykolaiv City District Prosecutor\u2019s Office<\/strong> to recover the land for the community.<\/p>\n<p>The plot covers <strong>1,000 square metres<\/strong>. It lies within the river\u2019s coastal protective strip and is also part of the city\u2019s public green space. The court found that, by transferring the land into private ownership, the <strong>Mykolaiv City Council<\/strong> had violated land, water and urban-planning laws. The court found the prosecutor\u2019s arguments to be well-founded.<\/p>\n<p>The law prohibits transferring such plots into private ownership for residential construction. Coastal protective strips and public-use land may be owned only by the state or a local community. These areas are intended, among other things, to ensure people\u2019s free access to bodies of water, so transferring them into private hands is prohibited.<\/p>\n<p>Since the beginning of <strong>2026<\/strong>, courts have upheld <strong>10<\/strong> similar claims brought by the prosecutor\u2019s office. Under the rulings, the city is to receive back water-fund land plots covering a total area of <strong>1 hectare<\/strong>.
