The Korabelnyi District Court of the city of Mykolaiv<\/strong> found a service member guilty of fraud after he received 1,200 US dollars<\/strong> from the victim under the pretext of subsequently transferring vehicles, but did not fulfill his obligations. He was fined 34,000 UAH<\/strong>.<\/p>\n

The verdict in the case<\/a> No.488\/3411\/26<\/strong> was delivered by the court on 15 July 2026<\/strong>. The criminal proceedings were registered in the Unified Register of Pre-trial Investigations under No.42025152410000196<\/strong>. According to the court register, the verdict came into legal force on 15 August 2026<\/strong>.<\/p>\n

The convict\u2019s name is redacted in the published decision. It is known that he is a native of the village of Savran in Odesa Oblast, a citizen of Ukraine, has secondary education, is married and supports two<\/strong> minor children. He had no prior convictions.<\/p>\n

At the time of the incident he was serving under conscription during mobilization with the rank of senior sergeant and held the position of material supply sergeant of the fire support company of a marine battalion in one of the military units.<\/p>\n

According to the circumstances established during the pre-trial investigation, on 27 January 2026<\/strong> at about 11:30<\/strong> the service member was near building No.48<\/strong> on Okeanivska Street in Mykolaiv<\/strong>.<\/p>\n

The investigation found that the man, acting intentionally, motivated by gain and with the purpose of illegally appropriating another\u2019s property, under the pretext of subsequently transferring vehicles, received from the victim 1,200 US dollars<\/strong>.<\/p>\n

At the official exchange rate of the National Bank of Ukraine at that time, this amount was 51,750.36 UAH<\/strong>.<\/p>\n

After receiving the money, the service member did not fulfill the obligations he had undertaken: he did not transfer the vehicles to the victim, did not return the funds, and disposed of them at his discretion. The pre-trial investigation body qualified these actions as unlawful appropriation of another\u2019s property by deception.<\/p>\n

The prosecutor asked the court to consider the criminal misdemeanor in a simplified procedure \u2014 without holding a court hearing and without the parties\u2019 participation.<\/p>\n

The accused, with his lawyer, unconditionally admitted guilt in writing under Part 1 of Article 190 of the Criminal Code of Ukraine<\/strong>. He also confirmed that he understood the circumstances established by the investigation and does not dispute them.<\/p>\n

The defense counsel confirmed the voluntariness of such consent. The victim also agreed in writing with the established circumstances and did not object to the consideration of the indictment without being summoned to court.<\/p>\n

After examining the indictment and case materials, the Korabelnyi District Court of the city of Mykolaiv<\/strong> found the service member guilty of fraud under Part 1 of Article 190 of the Criminal Code of Ukraine<\/strong>.<\/p>\n

In determining the punishment, the court took into account that the offense is a criminal misdemeanor, no serious consequences occurred, and the victim had no claims against the accused at the time of the trial.<\/p>\n

At the same time, the verdict does not state that the received 1,200 US dollars<\/strong> were returned to the victim, so it is impossible to conclude from the published decision whether this amount was reimbursed.<\/p>\n

The court also took into account that the service member had no prior convictions, supports two<\/strong> minor children and is positively characterized at his place of service.<\/p>\n

The court recognized sincere remorse as a mitigating circumstance. No aggravating circumstances were established.<\/p>\n

As a result, the senior sergeant was found guilty of fraud and was fined 2,000<\/strong> non-taxable minimum incomes of citizens \u2014 34,000 UAH<\/strong> in favor of the state.<\/p>\n

No civil claim was filed in the criminal proceedings; there are no court costs.<\/p>\n
