The corresponding ruling of <strong>24 August 2026<\/strong> in case <strong>No.915\/1213\/26<\/strong> was issued by Judge <strong>Davchenko T.M.<\/strong><\/p>\n<p>The debtor is registered at: Naberezhna Street, <strong>64<\/strong>, village <strong>Halytsynove, Mykolaiv Raion, Mykolaiv Oblast<\/strong>. Korabelov.info previously reported that &#8220;Service Center &#8220;Metallurg&#8221; is a unit of the nationalized Mykolaiv Alumina Plant. In particular, in <strong>2024<\/strong> the court <a href=\"https:\/\/korabelov.info\/2024\/05\/453001\/pensijnyj-fond-vyhrav-u-sudi-dilo-pro-borhy-z-natsionalizovanoho-mhz\/\">ordered the enterprise to pay the Pension Fund over 1.9 million hryvnias<\/a>.<\/p>\n<p>Importantly, the enterprise has not yet been declared bankrupt, and bankruptcy proceedings have not been opened. The court only accepted the creditor&#8217;s application for consideration. The validity of the claimed claims and the existence of grounds for opening proceedings will be checked during the preparatory hearing.<\/p>\n<p>LLC &#8220;Miroil&#8221; filed the application on <strong>11 August 2026<\/strong>, and it was received by the court on <strong>12 August<\/strong>. The creditor asks to recognize monetary claims against &#8220;SC &#8220;Metallurg&#8221; in the total amount of <strong>UAH 825,811.56<\/strong>, of which:<\/p>\n<ul>\n<li><strong>UAH 126,847<\/strong> \u2014 claims of the first priority;<\/li>\n<li><strong>UAH 698,964.56<\/strong> \u2014 claims of the fourth priority.<\/li>\n<\/ul>\n<p>The creditor also proposed to appoint the insolvency administrator <strong>Potupalo Nataliya Ihorivna<\/strong> as the property manager, who gave her consent to participate in the case.<\/p>\n<p>Separately, LLC &#8220;Miroil&#8221; requested to obtain the VAT tax reports of &#8220;SC &#8220;Metallurg&#8221; for <strong>2021\u20132022<\/strong>. This concerns declarations and annexes that reflect the creditor\u2019s tax invoices.<\/p>\n<p>LLC &#8220;Miroil&#8221; explained the need to obtain the documents by stating that its primary accounting records remained in a rented office in temporarily occupied <strong>Berdyansk, Zaporizhzhia Oblast<\/strong>. The creditor contacted the debtor with a claim and a request to provide the relevant reports, but received no response. The Main Department of the State Tax Service in <strong>Mykolaiv Oblast<\/strong> also refused to provide the company with this information.<\/p>\n<p>The court granted the creditor\u2019s motion and obliged &#8220;SC &#8220;Metallurg&#8221; to provide its incorporation documents, a response to the application, and VAT tax reports for <strong>2021\u20132022<\/strong> no later than <strong>three days<\/strong> before the hearing. The Tax Service was ordered to transfer the necessary documents by <strong>3 September 2026<\/strong>.<\/p>\n<p>The preparatory hearing is scheduled for <strong>7 September 2026 at 15:30<\/strong>. It is to take place at the Commercial Court of <strong>Mykolaiv Oblast<\/strong> at: city of <strong>Mykolaiv<\/strong>, O. Vadaturskyi Street, <strong>14<\/strong>. The creditor\u2019s representative <strong>Zabarin Anton Fedorovych<\/strong> will participate in the hearing remotely.<\/p>\n<p>Pending consideration of the question of opening proceedings, the court prohibited the owner of the property and LLC &#8220;Service Center &#8220;Metallurg&#8221; itself from making decisions on liquidation or reorganization of the enterprise, as well as from disposing of its fixed assets.<\/p>\n<p>This is not the first court case related to the enterprise\u2019s financial obligations. In <strong>November 2024<\/strong> the Commercial Court ordered &#8220;SC &#8220;Metallurg&#8221; to <a href=\"https:\/\/korabelov.info\/2024\/11\/479682\/natsionalizovanyj-mhz-prohrav-shche-odnu-spravu-u-sudi\/\">pay a supplier almost UAH 185,000<\/a>.
