In Mykolaiv<\/strong>, the Central District Court held a service member accountable who, while performing official duties, failed to ensure continuous video recording of citizen notification events. The court fined him 17,000 hryvnias<\/strong>, and characterized his actions as negligent conduct of military service during a special period. The decision was reported on August 11, 2026<\/strong> by the Verkhovna Rada Commissioner for Human Rights, Dmytro Lubinets<\/a>.<\/p>\n

The ombudsman emphasized that the situation should serve as a signal to all representatives of TCK and SP who participate in citizen notification events. According to him, the Instruction approved by the Ministry of Defense of Ukraine No. 532<\/strong> clearly defines the procedure for using portable video recorders.<\/p>\n

“This is an important signal for everyone. I once again stress the necessity of complying with the Instruction approved by MoD Order No. 532. It obliges representatives of TCK and SP to turn on the body camera at the start of notification events and keep recording continuously until their completion,” emphasized Dmytro Lubinets.<\/strong><\/em><\/p>\n<\/blockquote>\n

The Ministry of Defense’s official clarification also provides that recording must begin from the moment a TCK and SP representative begins performing official duties during a notification and continue continuously until those events are completed. Members of notification groups are prohibited from independently deleting or altering recordings, switching off the camera, or otherwise obstructing video recording.<\/p>\n

At the same time, the rules provide certain exceptions. Video recording may be interrupted if there is a risk of capturing military facilities or information with restricted access in the frame. The camera may also be temporarily turned off for short personal reasons, for example when visiting the restroom or eating.<\/p>\n

Dmytro Lubinets reported that he receives far more complaints about possible human rights violations during mobilization activities than become known to the public. In his words, in high-profile cases the same problem often arises: the parties make mutual accusations, only fragments of video appear online, and participants’ accounts contradict one another.<\/p>\n

“I am convinced: if each notification event were continuously recorded on video from the first to the last minute, it would be much easier to untangle this mess. Mandatory video recording was introduced precisely to protect both citizens and service members, and, most importantly, to establish the truth. It is an answer to the public demand for transparency of actions during notification events. When we see balaclavas, switched-off cameras or no video recording at all, when it is impossible to determine who exactly conducted the mobilization activities \u2014 that is no longer about transparency. It creates space for lawlessness, impunity and undermines people’s trust in state institutions. And this cannot be tolerated. If TCK and SP representatives act lawfully, professionally and do not violate human rights, they have nothing to hide. On the contrary, they should be the most interested in every action being recorded and every disputed moment being verifiable,” the ombudsman is convinced.<\/em>.<\/p>\n<\/blockquote>\n

At the end of his address he warned about the dangerous consequences of further accumulation of social tension around mobilization activities and stressed that the requirements of the law must be applied equally by everyone.<\/p>\n

“If this lawlessness is not stopped immediately, social tension could lead to consequences that will be impossible to fix! The law must apply equally to everyone. It is compliance with the rules, not their disregard, that forms the foundation of the rule of law even in wartime,” warned Dmytro Lubinets.<\/strong><\/em><\/p>\n<\/blockquote>\n

Thus, a TCK representative’s body camera was required to operate from the start of notification events until their full completion, except for circumstances explicitly provided for by the Instruction. The Ministry of Defense explains that mandatory use of cameras is intended not only to monitor TCK representatives but also to protect them from false accusations in the event of conflicts with citizens.<\/p>\n
