At the Inhulskyi District Court of Mykolaiv<\/strong> on Wednesday, June 24<\/strong>, a preventive measure was chosen for the serviceman of the Korablenyi District TCC and SP<\/strong>, Oleksandr Kozakov<\/strong>, who is suspected of causing a high-profile traffic accident on Bohoyavlenskyi Avenue<\/strong>. The court placed him in custody with the possibility of posting bail in the amount of 998 400 hryvnias<\/strong>, reports\u00a0PN<\/a><\/p>\n

This concerns the accident that occurred on the evening of June 22<\/strong> on Bohoyavlenskyi Avenue<\/strong> in Mykolaiv<\/strong>. Initially, a Volkswagen Passat<\/strong> and an Opel Mokka<\/strong> collided there. No one was injured in the first collision, but the vehicles remained on the roadway and were awaiting the formal accident report.<\/p>\n

About 5 minutes<\/strong> later, a BMW X6<\/strong> traveling at speed crashed into these stationary cars; according to the investigation, it was driven by a 43-year-old<\/strong> serviceman of the Korablenyi District TCC and SP<\/strong>. At the time of the accident he was off duty.<\/p>\n

As a result of the second collision 3<\/strong> people were injured – two men aged 23<\/strong> and 31<\/strong>, and a 28-year-old<\/strong> woman. According to preliminary data, two men were hospitalized in serious condition; among the injured was also a pregnant woman.<\/p>\n

At the start of the hearing the defendant asked that no photos or videos be taken of him. After that the court prohibited the publication of any images or videos featuring him from the courtroom.<\/p>\n

The motion was considered by Judge Hennadiy Valihurskyi<\/strong>. The prosecution was represented by prosecutor Roman Kalach<\/strong> of the Mykolaiv Specialized Prosecutor’s Office for Defense of the Southern Region<\/strong>. Investigator Kostyantyn Kurunchak<\/strong> was also present at the hearing, and the defendant\u2019s defense was represented by lawyer Hennadiy Boychenko<\/strong>.<\/p>\n

The prosecutor requested that Oleksandr Kozakov<\/strong> be placed in custody with the possibility of posting bail of no less than 902<\/strong> subsistence minimums – 3 001 856 hryvnias<\/strong>. The prosecution cited the seriousness of the charge, risks of influencing witnesses, the possibility of absconding and other risks to the criminal proceedings.<\/p>\n

According to the prosecutor, the defendant\u2019s family had significant financial means: the combined income for the previous year amounted to almost 5 million hryvnias<\/strong>. The court also heard about the purchase of an expensive BMW X6<\/strong>, which was the vehicle involved in the accident.<\/p>\n

The prosecutor additionally stated that the defendant had previously been held administratively liable, in particular for driving a vehicle without documents. The defendant denied that in the part where, he said, the case was closed due to the absence of an administrative offense.<\/p>\n

The court also heard that Oleksandr Kozakov<\/strong> is married and has a 17-year-old<\/strong> daughter who lives in Kyiv<\/strong>. He is registered and resides in Mykolaiv<\/strong>, has a Group III<\/strong> disability, an officer’s ID, veteran of war status, and previously worked in law enforcement.<\/p>\n

According to information disclosed in court, he has worked at the Korablenyi District TCC and SP<\/strong> for about 2 weeks<\/strong>. The defendant clarified that he currently holds the position of head of the recruitment department.<\/p>\n

The prosecutor also emphasized that, according to his information, even after 12 hours<\/strong> following the accident Oleksandr Kozakov<\/strong> was in a state of alcohol intoxication. Prior to that, according to the investigation, the BMW X6<\/strong> driver refused to undergo a medical examination, after which the court allowed the forced collection of biological samples for examination.<\/p>\n

The defendant himself stated in court that from 2023<\/strong> to 2024<\/strong> he served near Kupiansk<\/strong>, was wounded, and subsequently underwent treatment. According to him, after being discharged from the Armed Forces of Ukraine in 2024<\/strong> he was staying in Mykolaiv<\/strong>.<\/p>\n

He denied that he could influence the victims or witnesses. Regarding his refusal to undergo a sobriety test the defendant explained that his blood pressure rose and he felt unwell after the accident. For that reason, he said, the biological samples were to be taken the following day.<\/p>\n

Separately, Oleksandr Kozakov<\/strong> spoke about money. He stated that he does not have funds for the bail requested by the prosecutor. According to him, the nearly 5 million hryvnias<\/strong> mentioned by the prosecution were payments to his wife for housing damaged as a result of hostilities. These funds, the defendant claimed, were received into an account and then used to purchase other housing.<\/p>\n

Regarding the BMW X6<\/strong>, he explained that 900,000 hryvnias<\/strong> were received by him as a person wounded while defending Ukraine<\/strong>, and it was with that money, he said, that the car was purchased.<\/p>\n

The defendant asked the court not to place him in custody but to impose house arrest, citing the need for treatment and rehabilitation.<\/p>\n

The defense supported the defendant\u2019s position. Lawyer Hennadiy Boychenko<\/strong> stated that while the suspicion is substantiated, in his view the risks cited by the prosecutor have not been proven. The defense also disagreed with the bail amount of over 3 million hryvnias<\/strong>.<\/p>\n

The lawyer argued that one-off payments should not be included in the family’s total income. He said the defendant’s annual salary was about 400,000 hryvnias<\/strong>, and his wife’s about 200,000 hryvnias<\/strong>. According to the defense, it was precisely 600,000 hryvnias<\/strong> that should have been the basis for determining the bail amount.<\/p>\n

The defense also asked the court to take into account that the defendant worked in law enforcement from 2006<\/strong> to 2015<\/strong>. In addition, he drew the court\u2019s attention to the defendant\u2019s health after the accident, in particular elevated blood pressure of 180 over 120<\/strong>, and spoke of psychological pressure during the sobriety check.<\/p>\n

The defense insisted that the public outcry around the case arose because the suspect is an employee of the TCC. Should the court nevertheless order detention, the lawyer asked that bail be set at 200,000 hryvnias<\/strong>.<\/p>\n

Lawyer Hennadiy Boychenko<\/strong> told journalists after the hearing that the defense does not shirk responsibility and plans to assist the victims.<\/p>\n

“We do not shirk responsibility. We will seek the opportunity to treat the injured”.<\/p>\n<\/blockquote>\n

The defendant himself refused to comment to journalists. Asked whether he would plead guilty, he replied that conclusions could be made only after the pre-trial investigation is completed.<\/p>\n

After hearing the parties, the judge went to the deliberation room. As a result of the consideration, the court ordered Oleksandr Kozakov<\/strong> to be held in custody with the alternative of bail in the amount of 998 400 hryvnias<\/strong>.<\/p>\n

The man was charged under part 2<\/strong> of article 286-1<\/strong> of the Criminal Code of Ukraine – violation of road safety rules by a person operating a vehicle while intoxicated by alcohol, drugs or other substances, which caused serious bodily injury to the victim. The article\u2019s sanction provides for up to 8 years<\/strong> imprisonment with deprivation of the right to drive vehicles for a period of 5<\/strong> to 8 years<\/strong>.<\/p>\n

Earlier the Mykolaiv Regional TCC and SP<\/strong> reported that the serviceman was off duty and that an internal investigation has been initiated in connection with the accident. They stated a policy of “zero tolerance” for any unlawful actions by personnel.<\/p>\n
