Two children were left orphaned: in Kyiv a doctor was sentenced to 2 years for the death of a woman in childbirth; 15 million UAH were awarded

The Obolonskyi District Court of Kyiv found a 50-year-old obstetrician-gynecologist guilty of improper performance of professional duties that led to the death of the woman in labor. The doctor was sentenced to 2 years in prison, and civil claims for recovery of UAH 15 million in non-pecuniary damages in favor of the deceased woman’s two children were granted. The Kyiv City Prosecutor’s Office reported the verdict

The tragedy occurred in July 2023. A pregnant woman who went into labor was taken by ambulance to the Reproductive and Perinatal Care Center in Obolon. Court documents indicate that this concerns the municipal non-profit enterprise “Kyiv City Center for Reproductive and Perinatal Medicine”, located in Kyiv at 16 Volodymyr Ivasyuk Avenue

During the examination the doctor determined that the fetus had stopped developing. The 36-year-old patient began to have rapid labor. As the prosecutor’s office previously reported, medical protocols required a different management tactic in this situation. After the birth of the stillborn child the woman in labor was also to remain under regular medical supervision

According to the investigation, proper monitoring of the woman’s condition after delivery was not provided. The woman in labor sustained injuries to the birth canal and a hemorrhage that was not detected in time. The woman later died. An expert examination established a causal link between shortcomings in the provision of medical care and the patient’s death

The prosecutor proved in court that the obstetrician-gynecologist had the necessary qualifications and the means for timely diagnosis of the patient’s dangerous condition. According to the prosecutor’s office, had the injuries been detected in time and the necessary therapy begun, the woman’s life could have been saved

A criminal proceeding in this case was entered into the Unified Register of Pre-trial Investigations (ЄРДР) on 19 July 2023 under No. 12023100050002668. The doctor’s actions were qualified under Part 1 of Article 140 of the Criminal Code of Ukraine – improper performance by a medical worker of professional duties due to negligent attitude to them, which caused serious consequences for the patient

The subsequent fate of the deceased woman’s family was particularly tragic. The woman left behind two minor children. After his wife’s death their father became gravely ill and soon also died. The children were left orphaned and are now being raised by their grandmother and grandfather

On 8 December 2025, within the criminal proceeding, civil claims were filed in the interests of both minor children: UAH 7.5 million for each child, i.e. a total of UAH 15 million. To secure these claims, the investigation applied to the court for seizure of the suspect’s property

Now the Obolonskyi District Court of Kyiv found the 50-year-old obstetrician-gynecologist guilty and sentenced her to 2 years in prison. In addition, the court granted the civil claims and ordered the convicted doctor to pay UAH 15 million in non-pecuniary damages to the benefit of the deceased mother’s children. The public prosecution in the case was supported by prosecutors of the Obolon District Prosecutor’s Office of Kyiv
