In Mykolaiv, compensation was denied after a direct hit to a house: why and what to do
The main reason — the absence of legal title documents; experts recommend restoring ownership rights and submitting a new application
At a briefing at the Mykolaiv city council Mykolaiv, dedicated to residents’ participation in the state program «eRecovery», it was reported that one of the main reasons for refusals of compensation for damaged or destroyed housing in Mykolaiv is the lack of documents proving ownership; this was said by the head of the Department of State Architectural and Construction Control, Olena Tuova, who gave the example of the owner of a private house that was directly hit and was denied payment.
According to the official, negative decisions are most often made regarding applicants who cannot prove ownership of a house or an apartment. She cited a recent case: despite the severity of the damage, compensation was not assigned because the property was never officially commissioned.
-In January there was a direct hit on the house. This is third category. That is, the person had the right to receive full compensation. But, unfortunately, since 1998, when he built the house, he did not take any steps to commission this object, – said the official.
She emphasized that even if a building is not officially commissioned, there are legal mechanisms that allow you to legalize your right to the property and later claim compensation.
-If you acquired the right to use the house before April 2015, you have the right to submit an amnesty declaration to us, exercise your right and commission the object. Or if your house was built after 2015, you can file a claim in court, have your ownership recognized, and only then contact us regarding the declaration to commission the object. All of this works, – reported Olena Tuova.
In 2025, 78 declarations were registered under the “construction amnesty”, and there are also examples of court decisions by which citizens confirmed their ownership rights.
Regarding the multi-apartment housing stock, a draft law is currently being prepared that should allow the privatization of completely destroyed or damaged apartments so that their owners can receive compensation, since privatization of housing is currently suspended. The final parameters of the document have not yet been approved, the head of the relevant department noted.
-Whether it will be adopted, in what form, and what the procedure will be is not yet known, – Tuova said.
