At the time of the offense, the serviceman was absent without leave from his unit
In the Central District Court of Mykolaiv, a verdict was announced for a serviceman who beat his comrade and left him at a cemetery; the man was sentenced to 7 years 5 months of imprisonment, the court press service reported.
Earlier, law enforcement received a report about the discovery of a body at a cemetery: this occurred on 27 November last year at one of Mykolaiv.‘s cemeteries.
The investigation established that the 40-year-old accused and the deceased had been drinking alcohol together on the premises of a private household in the Ternivka neighborhood.
Later an argument broke out between them. During the conflict the defendant struck the acquaintance on the head and torso, after which they moved to a corridor where the victim fell, and the attacker inflicted at least 12 blows with his hands and feet.
After the beating the defendant dragged the man outside, placed him on the frame of a baby stroller, transported him onto the grounds of the Ternivka cemetery and abandoned him. The victim died from the sustained injuries.
It was also established that at the time of the offense the suspect was AWOL (absent without leave from a military unit).
The hearing was presided over by investigating judge Volodymyr Aleynikov. In court the defendant confirmed that that evening they had been drinking together, they argued and he began to beat his comrade; he also admitted that he took him to the cemetery and left him, believing that he was still alive and would regain consciousness or receive help.
He insisted that he had only intended to beat him, not realizing that his actions would cause death.
As a result of the proceedings, the court found the man guilty under part 2 of Art. 121 of the Criminal Code of Ukraine and sentenced him to 7 years 5 months of imprisonment. In addition, he was ordered to pay the costs of the examinations in the amount of 96 962 hryvnias.
